According to reports out of a county just west of Atlanta, a high school teacher, Jonathan Carr, pleaded guilty to DUI, serious injury by vehicle, and driving without proof of insurance four years ago in 2015.
As a result of driving under the influence, Carr drove into the yard of a family home and hit a teenager who was standing in the yard talking on a cellphone.
Carr had no criminal record other than a speeding ticket.
He was sentenced to 180 days in a detention center, 15 years on probation, a $5,000 fine, restitution and 300 hours of community service. He is also required by the Court to speak to high school students about the risks of drinking and driving and undergo a substance-abuse and a mental-health evaluation.
Although this happened outside of the city of Atlanta, the penalties are the same in the state of Georgia. In today's post, and as an Atlanta DUI Lawyer, I will outline the penalties faced if arrested for your first DUI in Atlanta.
Atlanta DUI Penalties
For a first offense DUI in Atlanta, the maximum penalties by law can include:
- Twelve months in jail
- $1,000 Fine
- 1 Year License Suspension
- Mandatory clinical evaluation for drug/alcohol dependency
- Completion of a treatment program, if drug/alcohol dependency is clinically diagnosed (at your cost)
- Completion of DUI School
- 40 hours of community service
For a first offense DUI in Atlanta, the minimum penalties by law can include:
- 24 hours in jail
- A fine of $300
- Suspension of your driver's license for a period of time
- Completion of DUI School
A DUI is classified as a misdemeanor offense and therefore, a DUI cannot be expunged off your record.
